    As far as normal fisheries methods go, the whalers are using a sustainable method and are catching below most normal TAC's (1% or less) that I have seen.

    I believe you are correct.How can a ship that is not moving be considered at fault for a collision? ::)

    From my understanding, a boat is always in motion when in the water.

    And yes I did watch.(painfully most of the time) They were out of gas.

    I guess it was just a big coincidence of all the ocean they were out of gas in the path of a whaling ship... what are the odds of that :p

    If they weren't intent on harassing in the first place... out of gas is moot IMO. It's paramount to a thief suing a homeowner for leaving knives out for him to fall on when he breaks in through a window... whatever.
