I hate my power company, about ready to give up.

    My wife is an attorney who was an assistant State Attorney General for the State of Florida for about 8 years. I asked her about it and here is the skinny:

    - There is probably something in the contract that protects them against this, but you have to check.

    - That doesn't necessarily absolve them of any responsibility, however.

    - She suggested getting an attorney to draft a letter stating what happened, that they were negligent when they turned off power to the wrong apartment and that their mistake cost you in excess of $1500 (or whatever you decide).

    - In the letter state that you expect full compensation for your loss due to their negligence and if you don't get satisfaction you will file a complaint with the state and local governments as well as pursue further legal action to recover your losses.

    They won't want to fight this and will likely settle, but be aware that an attorney doing this and covering the followup will not be cheap. That's why I'd recommend upping the amount of the damages to help cover.

    Well got the tank temp up and the water changed out. all the critters are dead except the cuc from reafcleaners. looks like one or two heads of the red zoo might make it but the green and the blueish ones are gone alone with the blasto, acans, plate, brain, frog spawn, hammer, xenia, favias, leather, and nori. sigh. going to stop by a lawyer tomarow see what they say

    I work for the largest electric company in the United States, and I can tell you that the Electric Company is more than likely self insured, and should cover the damages from their mistake...we have had things like this happen before....just keep working up the ladder until someone helps you

    This is no different from hitting a mailbox, or other damage...it should be covered

    Yes, you must not give up, both the legal pursue and hobby pursue. Just hang in there.

    Get a hold of your P.U.C. and they may have a phone number for the right person to talk to. Or you can be like my father and just ask for the manager and when that person cant help you say why are you wasting my time now I want to talk to your boss. He is 70 and is a trip to go to the store with.

    Well looks like I’m pretty much fd. talked to a lawyer today and since the power company responded to the outage within a reasonable amount of time and since I accepted their offer of a free "express" hook up I’ve basically waived my right to pursue any addition compensation

    wow I disagree with that 100% If I were you I would still take it to small claims court big deal if they came out and fixed the problem after everything died they still cause everything to die, just like a doctor visit bro I would still get a 2nd opinion or at least take em to small claims, $1000 is alot of money :-/

    Find out if your power company is sanctioned by the PSC (Public Service Commission) if so, you may need to get in touch with them as well....Utility companies never want to get them involved.
