I hate my power company, about ready to give up.

    Well **** the insurance wont do anything they would cover the tank, lights ec. but nothing living and the power company wont do **** saying its up to me to report an outage grrrrr

    Honestly, I'm on power companies side. I totally think it's bs and sucks out the kazoo but they did restore it as soon as it was pointed out didn't they? I'd imagine somewhere in the contracts none of us ever reads it specifies that.

    Not to say I wouldn't try to pursue it, but I don't have high expectations.

    I don't know how much value you have in your livestock... I might file small claims too like mentioned above. I've filed that before on a shady contractor and it was a fairly easy process... In my case they just gave my money back and we parted ways - never went to court (that's the goal really).

    dude def dont give up on this you have an extremely good case you just have to be persistent and not take no for an answer if you have any lawyer friends I would take it up with them, the loss of your tank is in direct result to their mistake, wether it was a power outage for 1 day or 3 that is irrellivant the fact is that they killed your tank by turning off your power just stay strong with it

    The power company is liable for any damages incurred because of their negligence. This would definitely count as their negligence.

    It's a matter of the initial shutoff being negligent, not their conduct afterwords, which was quite good as you describe it.

    well i had $8-900 in fishies and coral mostly coral. went up to the lfs and got 40g of water ill change out 20 tonight and 20 tomarow and start bringing the tank temp up dont realy know what else to do. hopefully some of the coral perks up

    small claims court. they were negligent in their actions.

    Srry to hear about this I know I would be pissed but take that negative energy you have and direct it right at them. They should pay for this stuff 110% this is there fault and hate to say it but its almost worth hiring a lawyer over. Good luck let us know what happens.

    to be honest If I were you bro I would at least talk to a lawyer and maybe sue them for all damages including emotional trauma from the loss of your beloved fish I really hope you don't let them literally get away with murder

    If your are talking small claims it is an informal hearing in front of a magistrate usually no lawyers. Would be you and a company rep. Small claims in Indiana has a 6g limit so it would qualify. In Colorado there is a small filing fee and you have to pay a process server or Deputy to serve the subpoena but you can tack that onto your case. If you start talking small claims they may settle because it will cost them more than 900 in legal consultation before they even get there. The Indiana court site lists the small claims procedure here.
